Definition of Foreigners Entering Vietnam

Foreigners are those who have foreign nationality or are stateless, entering, exiting, transiting, and residing in Vietnam. Among them, entry is the act of foreigners entering Vietnam’s territory through Vietnam’s border gates. Conditions For Foreigners To Enter Vietnam

Foreigners need to meet certain conditions to be able to enter Vietnam. These conditions are stipulated in the Law on Entry, Exit, Transit, and Residence of foreigners in Vietnam 2014, amended and supplemented in 2019. Specifically, foreigners need to have a passport or international travel document and visa, except for cases exempted from visas under the provisions of Vietnamese law. In addition, foreigners do not fall under the cases not yet allowed to enter as prescribed in Article 21 of this Law.

Rights and Obligations of Foreigners When Entering Vietnam

When entering Vietnam, foreigners are protected in terms of life, honor, property, and legitimate rights and interests according to Vietnamese law. They also have the right to travel on Vietnamese territory, to travel, visit relatives, get medical treatment without permission. Specifically, the rights and obligations of foreigners when entering Vietnam are stipulated in Clause 1, Article 44 of the Law on Entry, Exit, Transit, and Residence of foreigners in Vietnam 2014 (amended 2019).

However, foreigners also have obligations to comply with. They must comply with Vietnamese law; respect the cultural traditions, customs, and practices of Vietnam; activities in Vietnam must be consistent with the purpose of entry. When traveling, they must carry a passport or international travel document, documents related to residence in Vietnam and must present when the competent authority requests; permanent resident foreigners, if exiting to reside in another country, must return their permanent residence card to the immigration control unit at the border gate.
