They are increasing medical leave to avoid dismissal during the probationary period. This is a consequence of the abuse of companies to use this period to terminate contracts, as an alternative to temporary contracts. This implies that there are a greater number of cases in court for fraud, both by the company and by the workers.
Enrique Ceca, a partner in the labor area, comments in La Información that the fact that an employee leaves before the end of the probationary period “complicates the company’s decision, since the employee wins an argument in the face of the judicial process.”
Our labour lawyer adds: “This protection also exists for victims of gender violence, maternity or paternity leave or in the first twelve months after birth or fostering. If he is not in these situations and he thinks they are going to do without him, he may choose to request a leave, since although most are justified, they are given with some ease”.
