Biography

Klim is the head of Arzinger’s International Trade and co-head of the Investment practices focusing on areas of Transport and Logistics, Infrastructure, IT, Media and Retail. He is a commercial contracts lawyer with a focus on all what relates to innovative technologies, data protection and IP. Klim’s legal advice helps Arzinger’s clients assess the risks while scaling their business models in Belarus and abroad.

Klim is experienced in developing draft regulatory legal acts, including legislation in the field of investment and the Decree on Hi-Tech Park; member of several state Expert Councils (within the Ministry of Economy, the Ministry of Justice, the Ministry of Information).

KEY PROJECTS

• Advised UBER group on activities in Belarus, regulation of road transport, registration of financial transactions, relations with government agencies, acquisition of Belarusian companies.
• Supported the entry of the world’s largest fashion retailer from Spain into the Belarusian market with seven brands: within registration of legal entities in Belarus, creation of the corporate structure, support of activity of Belarusian companies in all the matters related to commercial activity.
• Assisted a consortium of private investment banks backing up creation of a JV of Uber and Yandex. The mandate covered Belarusian law financial and regulatory advice with an emphasis on default mechanics and repayment guarantees.
• Advised a large manufacturer of medical equipment with production facilities in the Republic of Belarus, the EU, the UK and the USA on the restructuring of local business to reduce the risks associated with sanctions restrictions.
• Represented the interests of seven cable production plants from Russia, Belarus and Kazakhstan, an Azerbaijani manufacturer in the field of metallurgy at all stages of the anti-dumping investigation within the EAEU, including the preparation of comments on the applicant’s statement and responses to questionnaires from the EEC Internal Market Protection Department, as well as participation in public hearings.
• Advised the largest consortium of German banks on a number of projects implemented in Belarus in the context of sanctions compliance, as well as on enforcement procedures of Belarusian counter-sanctions legislation.
• In light of recent EU sanctions, advised several EU-based financial institutions (German, Austrian, Dutch) on the terms of enforcement of the sovereign guarantees issued by the Belarusian Government, recommended the strategies for amicable solution.
