Michael Terceiro is the owner of Terceiro Legal Consulting Pty Ltd (TLC). TLC is a law firm which specialises in competition/antitrust and consumer law. TLC has been operating since 2008 and has represented numerous companies and businesses in Australian Competition and Consumer Commission (ACCC) matters. Michael has achieved outstanding results for his clients, such as avoiding both adverse publicity and formal sanctions at the conclusion of an ACCC investigation. Michael provides clients with practical, creative and insightful competition and consumer law advice.
Michael also has a range of part time – advisory roles – namely:
• General Editor of the Thomson Reuters publication, the Australian Business Law Review
• expert consultant on competition and consumer law to both Lexis Nexis and Wolters Kluwer/CCH
• Deputy Chair of the Mortgage and Finance Association of Australia (MFAA) Disciplinary Tribunal since 2010
• Oral Assessor for the NSW College of Law
• Online Learning Advisor – Digital Law, Monash University
Prior to setting up TLC, Michael worked at the ACCC for 15 years. During this time, he worked as:
• the Director (in charge) of the Sydney Mergers and Asset Sales Branch
• the National GST Enforcement Coordinator
• a Director of Enforcement and Compliance in the New South Wales Regional Office
• the Director (in charge) of the ACCC’s Waterfront Team during the Waterfront Dispute.
In Michael’s various roles at the ACCC he ran more than 600 ACCC investigations, including more than 100 merger clearances, and 30 court cases. Michael’s team success rate in litigation was more than 90%.
Michael is a member of the NSW Law Society, Australian Institute of Company Directors, and the Business Law Section of the Law Council of Australia. He is the Deputy Chair of the Small and Medium Enterprise Committee of the Law Council, a role he has held since 2013.
Michael’s qualifications include a Master of Dispute Resolution (with Excellence) from the University of New South Wales, Master of Laws from the University of Sydney, Professional Certificate in Arbitration from the University of Adelaide and a Bachelor of Laws from Macquarie University.
Established in 2008, TLC specialises in competition/antitrust and consumer law advice and providing representation in regulatory investigations and litigation.
TLC also assists clients with the design and implementation of Compliance Programs and the conduct of Independent Compliance Program Reviews. Clients which have retained TLC to conduct Independent Compliance Program Reviews of their compliance programs include Airbnb, Baby Bunting, InvoCare Australia, LG Electronics, Aldi Stores, Wilson Security, Thermomix and Dell Computers.
TLC also provides Independent Auditing services of ACCC mandated asset divestitures as part of merger approval processes including in relation to the Bingo acquisition of Dial A Dump and Brookfield Parties divestiture of its shareholding in Genesee & Wyoming Australia Holdings LP. TLC also provides mediation and arbitration services.
