Mr. A (a British national) and Ms. B (a Vietnamese national) decided to carry out the legal marriage registration procedure in Vietnam. Initially, they faced confusion, as Mr. A did not have permanent residence or household registration in Vietnam, and the application process involved numerous complex legal formalities. To ensure compliance with legal regulations, Mr. A and Ms. B sought detailed guidance and professional assistance from Harley Miller Law Firm.

Preparation of Documents by the Parties

For Mr. A (foreign national):

  • Marriage registration declaration form
  • Certificate issued by a competent medical institution confirming that he does not suffer from any mental illness or other condition that renders him incapable of awareness and self-control over his actions
  • Valid passport or a passport-substitute document (certified copy)
  • Certificate of marital status issued by a competent authority of the United Kingdom, confirming that Mr. A is currently not in any lawful marriage

All documents issued by foreign authorities must be legalized by the Embassy or the Consular Department of the Ministry of Foreign Affairs of Vietnam, and officially translated into Vietnamese and notarized in accordance with Article 2 of Decree No. 123/2015/ND-CP.

For Ms. B (Vietnamese national):

  • Marriage registration declaration form
  • Certificate issued by a competent medical institution confirming that she does not suffer from any mental illness or other condition that renders her incapable of awareness and self-control over her actions
  • Passport/Citizen Identity Card/National ID Card/Personal Identification Card/Electronic ID Card/Certificate of Personal Identification or other personal identity documents with photo and information issued by competent authority
  • Certificate of residence

Harley Miller Law Firm translated and notarized all of Mr. A’s English-language documents into Vietnamese. The firm also reviewed Ms. B’s documents to ensure they complied with legal templates and requirements. Before submission, the firm examined the entire application for validity, including the marriage registration declaration form, which they prepared in accordance with the template provided under Circular No. 04/2020/TT-BTP.

Mr. A and Ms. B submitted the marriage registration dossier to the Justice Division of Ho Chi Minh City, along with medical certificates (confirming no mental illness or other disqualifying conditions) issued by a licensed medical institution in Vietnam. Harley Miller liaised directly with the Justice Division, coordinated the interview appointment, and ensured that all information of both parties was complete and accurate.

After the verification and interview procedures were completed, approximately 15 days later, the Justice Division issued a legally valid Marriage Certificate to Mr. A and Ms. B.

In practice, the parties encountered several typical difficulties arising from the cross-border legal nature of the case, including:

  • Foreign national with no residence in Vietnam: This raised issues in determining the competent authority for marriage registration, which falls under the jurisdiction of the provincial-level Justice Division, in accordance with Article 38 of the Law on Civil Status 2014.
  • Consular legalization of foreign-issued documents: A competent Vietnamese agency must legalize foreign-issued documents such as the Certificate of Marital Status or Birth Certificate before anyone can use them in Vietnam, pursuant to Article 10 of the Law on Civil Status 2014.
  • Language and translation issues: Translators must translate all documents in foreign languages into Vietnamese and duly certify the translations in accordance with Circular No. 01/2020/TT-BTP.
  • Health check and interview requirements: Foreigner entering into marriage with a Vietnamese must obtain a medical certificate proving they do not suffer from any mental illness or condition affecting their awareness or behavior control, as required under Clause 2, Article 8 of the Law on Marriage and Family. Furthermore, as stipulated in Article 31 of Decree No. 123/2015/ND-CP, the Justice Division may conduct interviews to verify the voluntariness and authenticity of the marriage.

Analyze:
