Today, 18 July the #MinistryofEnergy has published the draft of the #OffshoreWind Law. This follows the recent public disclosure of the #MarineSpatialPlanning (MSP) draft, a key document for offshore-onshore projects.
Under the draft law, the Ministry of Energy will be responsible with the issuance of a study for determining all offshore blocks on which potential projects can be developed. The study will be finalized within 30 months as of the entry into effect of the law.
Also, the draft law provides that construction and operation of 3 GW offshore wind capacities will benefit of a support scheme through #CfDs.
The Ministry of Energy will be responsible, inter alia: 🔸 to organize tenders for the award of exploration and of the construction and operations phases; 🔸 to issue the exploration permit; 🔸 to conclude the concession agreements.
#ACRPO (Romania’s Offshore Safety Authority) will be responsible, inter alia: 🔸 to issue the construction/demolition permit (aka the development authorization); 🔸 to grant easement rights for onshore and offshore exploitation activities; 🔸 to issue permits for the development of other types of activities within the respective blocks.
#ANRE (Romania’s Energy Regulatory Authority) will issue the set-up permit and the production license.
Further, according to the draft the procedures for awarding the concessions and the exploration permit for offshore blocks must be put in place by the Ministry of Energy by 1 January 2027. Similarly, the procedures for awarding the concession for the construction and operations phase must be put in place by 30 July 2027. Last but not least, #secondarylegislation and #technicalnorms are to be issued by ANRE and #Transelectrica (Romania’s Power Grid Operator).

Comments to the draft law may be submitted to the Ministry of Energy by 17 August.
